Extending the deadline for an income or profit tax return does not automatically extend the deadline for paying the tax itself. Azerbaijan's State Tax Service highlighted the distinction in its November 5 explanation.
The service refers to Article 74.1 of the Tax Code. In circumstances provided for by law, a taxpayer may apply to extend the deadline for submitting the relevant return. Applications may also be filed electronically.
Track reporting and payment separately
Filing a return and transferring the tax are separate obligations. A decision on the reporting deadline should not automatically be treated as a decision on the payment date. Businesses should therefore track both dates separately in their tax calendars.
For example, approval of additional time to file a return does not by itself justify removing a payment from the calendar on its original due date. A change to the payment deadline needs a separate applicable basis. Merely sending an application should not be treated as confirmation that an extension has been approved.
Checks when applying
- Establish whether the circumstances fall within the legal grounds for extending the reporting deadline.
- Check the current service standard for application and document requirements.
- Submit the request through an approved channel and retain confirmation of submission.
- Review the response and separately establish the applicable tax payment deadline.
The Tax Service directs taxpayers to its unified service standards for required documents and the application procedure. The announcement does not introduce a blanket postponement of tax deadlines or a new exemption. It explains an application mechanism available subject to the established conditions.
